The legitimate, controlled, and informed processing of your Personal Data is of vital importance to achieve the corporate objectives of Flying Pictures de México, S.A. de C.V., through all areas of the business, reiterating our commitment to your privacy and the right to informational self-determination. Therefore, in compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, we make our PRIVACY NOTICE available to you.
The Privacy Notice will apply to all products, services, programs, and/or websites of Flying Pictures de México, S.A. de C.V., according to the nature of the Personal Data collected and in accordance with current and applicable legislation on privacy and protection of Personal Data. Flying Pictures de México, S.A. de C.V. may publish new specific Privacy Notices or updates, for which the express consent of the Holder of the Personal Data (the Holder) may or may not be required. However, through the website www.flyingpictures.mx, the privacy policies applicable to the Personal Data that have been granted to us will be made public and known to our clients.
A. NAME AND ADDRESS OF THE RESPONSIBLE PARTY
The processing, storage, custody, and disclosure of Personal Data that the Holder has disclosed or may disclose to Flying Pictures de México, S.A. de C.V., through various means and forms, including, but not limited to, Internet sites, technological tools, or directly to our representatives, for the use of our products and/or services, or for any related activity, shall be considered the responsibility of Flying Pictures de México, S.A. de C.V., which is a company incorporated in accordance with the laws of the Mexican Republic, with address at Viveros de la Hacienda 307, Col. Viveros de la Loma, Tlalnepantla, CP54080, State of Mexico.

To carry out the purposes described in this Privacy Notice, Flying Pictures de México, S.A. de C.V., based on the legal or non-legal relationship that exists with the Holder, may collect and, where appropriate, process Personal Data, including those considered sensitive, among which, by way of example but not limitation, are:

C. PURPOSES FOR THE USE OF PERSONAL DATA
The Personal Data we collect from the Owner is necessary for the fulfillment of obligations, the relationship, and/or the provision of services that exist or may exist between the Owner and Flying Pictures de México, S.A. de C.V., the latter being the one who uses, stores, transmits, or transfers them to the extent that the Law allows, to comply with the obligations derived from the legal or non-legal relationship that exists or may exist with the Owner.
Likewise, we inform you that in the facilities, balloon port, in each of our balloons and land vehicles, we have a video surveillance system, for which, images and audio of the Personal Data Owner may be obtained through our security cameras, for identification, control, and security purposes of users, suppliers, and personnel of Flying Pictures de México, S.A. de C.V.

E. TRANSFER AND REMITTANCE OF PERSONAL DATA
As part of the operations of the business and in order to fulfill the purposes described, Flying Pictures de México, S.A. de C.V. may share some or all of your Personal Data with national or foreign third parties.
Flying Pictures de México, S.A. de C.V. will ensure, through the signing of agreements and the adoption of other binding documents, that said third parties maintain adequate security, administrative, technical, and physical measures to safeguard your personal data, as well as that said third parties only use your Personal Data for the purposes for which they were collected and in accordance with this Privacy Notice.
Flying Pictures de México, S.A. de C.V., may share all or part of your Personal Data with authorized entities in accordance with Mexican Legislation for supervision in carrying out activities and operations related to our products, who may or may not process your Personal Data on behalf of Flying Pictures de México, S.A. de C.V., in accordance with the Purposes and Uses provided in this Privacy Notice. Likewise, Flying Pictures de México, S.A. de C.V. reserves the right to share your Personal Data with administrative, judicial, or governmental authorities of any kind in the United Mexican States.
Flying Pictures de México, S.A. de C.V., may transfer your Personal Data to advisors and collection service providers, any acquirer of the company, parent companies, affiliates or subsidiaries of Flying Pictures de México, S.A. de C.V., external professional advisors; and other providers that offer services, technical support, information technologies and in general, any third party that acts as manager in the name and on behalf of Flying Pictures de México, S.A. de C.V.
Flying Pictures de México, S.A. de C.V., may remit Personal Data to companies in charge of receiving, safeguarding, and processing the personal data of the Holder in terms of this Privacy Notice.
F. SECURITY MECHANISMS
Flying Pictures de México, S.A. de C.V., will implement the necessary security, technical, administrative, and physical measures to ensure the integrity of your Personal Data and prevent its damage, loss, alteration, destruction, or unauthorized use, access, or processing.
Only authorized personnel of Flying Pictures de México, S.A. de C.V., who have complied with and observed the corresponding confidentiality requirements, may participate in the processing of your Personal Data. Authorized personnel are prohibited from allowing access to unauthorized persons and from using your Personal Data for purposes other than those established in this Privacy Notice. The confidentiality obligation of the persons who participate in the processing of your Personal Data subsists even after the termination of the relationship with Flying Pictures de México, S.A. de C.V.
G. STORAGE OF YOUR PERSONAL DATA
Flying Pictures de México, S.A. de C.V., may keep your Personal Data in its databases located in the United Mexican States or abroad without any limitation, on the understanding that reasonable commercial technology and security policies and standards have been implemented to protect the information that has been provided to us.
H. MODIFICATIONS TO THE PRIVACY NOTICE
Flying Pictures de México, S.A. de C.V. reserves the right to modify the terms and conditions of this Privacy Notice, in which case the modification will be notified through the means of communication that Flying Pictures de México, S.A. de C.V. considers most appropriate for this purpose, which may be through email, notices in media, direct communication, and/or an announcement on our website or in our branches.
Flying Pictures de México, S.A. de C.V. as well as the Holder, acknowledge that this Privacy Notice is of unlimited duration. However, Flying Pictures de México, S.A. de C.V. will keep this Privacy Notice updated.
Flying Pictures de México, S.A. de C.V., recommends that the Holder reread this document regularly, so that they are always informed about possible modifications.
Alterations or modifications to this Privacy Notice will become effective immediately after their publication on the Flying Pictures de México, S.A. de C.V. website, www.flyingpictures.mx, without prejudice to the use of any other means by Flying Pictures de México, S.A. de C.V., for said publications.
Once the modifications have been made, it will be presumed that the Holder who continues to use the www.flyingpictures.mx website, requests its services, or performs the acts that gave rise to their relationship with Flying Pictures de México, S.A. de C.V., will have full knowledge, will have read and consented to the amended Privacy Notice.
I. CONSENT
The Holder declares and consents to this Privacy Notice, in accordance with the Law on Protection of Personal Data Held by Private Parties, not opposing the Privacy Notice. None of the Personal Data will be processed until 2 (two) days after they have been provided by the Holder and the Holder has not expressed their refusal.
J. ARCO RIGHTS
Likewise, the Holder may request to access their Personal Data, rectify them, cancel them, oppose, limit their use or disclosure, or revoke their consent, in terms of the Federal Law on Protection of Personal Data Held by Private Parties and other applicable provisions (the Request). To exercise these rights, the Holder must contact the Privacy Department, at the email address and/or telephone number(s) that appear above in our contact information.
In terms of the applicable law, any request to exercise the aforementioned ARCO rights must indicate the following essential requirements to respond to your request:
- Name and address.
- The documents that prove your identity or, where appropriate, the legal representation of the person making the request on your behalf.
- The clear and precise description of the Personal Data that you wish to access or that you wish to rectify, cancel or oppose, and any other element that facilitates the location of your data.
- Any other requirement established by the Federal Law on Protection of Personal Data Held by Private Parties and/or other applicable provisions.
At any time, the Holder may request that the sending of commercial messages or notices and information on new products be suspended or canceled, through our Privacy Department.
In case of requesting the rectification of personal data, you must additionally indicate the modifications to be made and provide the documentation that supports your request.
The response to your request will be communicated to you within a period of 10 (ten) business days, counted from the date the request was received, and may be extended by 5 (five) more days in cases where the Law so establishes; in order that, if appropriate, the necessary measures are taken to comply with your request, which will be carried out within 15 (fifteen) business days following the date on which the Holder is notified of the response to their request.
The Holder of the Personal Data must cover the justified shipping costs or the cost of reproduction in copies or other formats.
In the case of requiring physical shipment of information, Flying Pictures de México, S.A. de C.V., will require an address for said shipment.
In the event that the information is sent electronically, Flying Pictures de México, S.A. de C.V. will require an email address.
When the Personal Data is no longer necessary for the fulfillment of the purposes provided for in this Privacy Notice and the applicable legal provisions, it must be canceled, blocked and deleted by operation of law.
The Request will not be valid in the event of omission of the aforementioned.
In the event that the Holder has requested the right of Opposition to the processing of their Personal Data, Flying Pictures de México, S.A. de C.V., will consider the following:
- That there is a legitimate cause and the specific situation so requires, which must justify that even if the treatment is lawful, it must cease to prevent its persistence from causing harm to the Holder.
- That you need to express your opposition to the processing of your Personal Data so that the processing is not carried out for specific purposes.
- That the treatment is not necessary for the fulfillment of a legal obligation imposed on Flying Pictures de México, S.A. de C.V.
In case of having exercised the right of Opposition to the processing of your Personal Data, Flying Pictures de México, S.A. de C.V., will send the Personal Data to an Exclusion List in accordance with the Law (the List).
K. PROCEDURES FOR BLOCKING AND DELETING PERSONAL DATA
Once the Personal Data has been canceled, Flying Pictures de México, S.A. de C.V., will keep the Holder's Personal Data for one more month for clarification purposes and preparation for deletion. Once this period has expired, Flying Pictures de México, S.A. de C.V., will definitively block the Holder's Personal Data, and there will be no further opportunity to locate or contact the Holder.
If the Holder engages in another transaction with Flying Pictures de México, S.A. de C.V., they must initiate it as if the relationship had never existed.
The foregoing, observing the provisions in the Privacy Policies for the purposes of preserving information by legal mandate or authority.
Personal Data that has fulfilled its purposes, but cannot be canceled and/or deleted by legal mandate or by the existing contractual relationship, will be blocked from the purposes to which it was subjected, until it can be deleted. During this period, the Personal Data may not be subject to treatment beyond its conservation and protection.
L. REVOCATION OF CONSENT
Consent may be revoked at any time without retroactive effect. To revoke consent, the Holder must send a written request to the email solicitud.arco@flyingpictures.com.mx with the following requirements:
- Name of the Holder,
Address to which the response to your request will be sent - The documents that prove the identity of the Holder, IFE and/or PASSPORT, or, where appropriate, the legal representation of the Holder.
- A clear and precise description of the link you have with Flying Pictures de México, S.A. de C.V.
- Provide the documentation that supports your request.
- The request must be addressed to Flying Pictures de México, S.A. de C.V.
- Documents that prove that the legal relationship you had with Flying Pictures de México, S.A. de C.V. has ended.
Flying Pictures de México, S.A. de C.V., will issue a response in which it will confirm the revocation of the Holder's consent, or, where appropriate, indicate the reasoning depending on the specific case, having 15 (fifteen) days to issue this response. The deadlines will be counted from the moment the request sent via email enters our server, with Flying Pictures de México, S.A. de C.V., issuing the respective Acknowledgement of Receipt of Request.
Any request subsequent to the one mentioned in the previous paragraph will have the same effect as an initial one, with the Holder and Flying Pictures de México, S.A. de C.V., being bound by the same deadlines indicated above.
The request will not be valid in the event of omission of the above.
M. JURISDICTION
This Privacy Notice, the processing of your Personal Data and/or all related documents are governed by the Federal Law on Protection of Personal Data Held by Private Parties and other laws and regulations of the United Mexican States.
The acceptance of this Privacy Notice or the simple request for services once this Privacy Notice has been published and made available implies an express acceptance by the Holder of its terms and their express submission to the competent courts of Mexico City, Mexico, for any controversy or claim arising from this Privacy Notice.
I declare that I have read and understand this Privacy Notice and grant my consent, where necessary, for the processing of my Personal Data under the terms hereof. I confirm that I have informed the persons from whom I have provided Personal Data, about the treatment that will be given to their Personal Data.
